Terms, Conditions and Privacy Policy

Your privacy and the protection of your data are important, both for you and for us. Reading our Terms and Conditions, as well as our Privacy Policy, is imperative for you to know and accept the way that you make available and authorize the collection of your personal data, as well as their use and disclosure thereof, in accordance with which is defined here.

Treatment of your personal data

The processing of your data is in compliance with Regulation (EU) 2016/679 of the Parliament and of the Council, called the ‘General Data Protection Regulation’, effective as of May 2018. In accordance with European legislation, a legal basis is needed to process your data, always having the right to consult and ask for them to be deleted.

Changes to the Privacy Policy and Terms and Conditions

This page will be updated whenever changes occur, and these can be changed at any time by decision of WOSP, hence we advise you to consult it periodically.

Personal data

When you visit wosp.pt we automatically collect the following information about you:

  • WOSP pages you visit;
  • When you made the visit;
  • Your IP address;
  • Which Web browser is used;
  • What website originated your visit (if applicable);

In addition to the above, we also collect data when submitting requests for information, available at various locations on wosp.pt.

This data is: name, email, subject and message.

 

Cookies and Google Analytics

What is a cookie?
A cookie is a small set of data sent from a website and stored in the visitor’s browser while the visitor visits it. Saved information can be retrieved during the same session or during subsequent visits, even in the distant future.

This uses cookies to help you analyze how you use this site. Information generated by the cookie about your use of the site will be transmitted and stored by Google on servers in the United States. Your IP address will be truncated by Google within an EU Member State or another EEA State before being transmitted to the US. Only in exceptional situations will your full IP address be transmitted to Google servers in the United States and truncated there. Objectives of using your data

WOSP uses your data in order to provide you with the platform in the best possible way, using the data to improve, develop and generate statistics of its use, thus being able to provide you the services that you can access through your use of it, thus creating a better experience for both you and those who may also enjoy it.

 

WOSP Registration

If you do not register with WOSP, we will only store data relating to your current session, working cookies, used forms and potential errors in using the site, as well as the Google Analytics data described above.
When you register at WOSP you will get your own profile and space in it, in order to provide it to you we need to collect the following data:
Name and Email;

You can complete your profile with non-mandatory information: First Name, Last Name, Phone, Mobile, Skype, Facebook URL, Twitter, Linkedin and Pinterest, a short text about yourself, your location, spoken languages and a private field (which will only have access to you and us, the team that provides the WOSP platform).
You can contact us at any time to question the need to store data that you do not agree with.

Multimedia

When uploading images to the site, you should avoid loading images with embedded geolocation data (EXIF GPS). Visitors can download and extract geolocation data from images from the site.

 

Terms of Service

  1. WOSP provides booking services for both users (looking for spaces) and their providers (who want to make space available to users on a temporary basis). It should be noted that WOSP is a digital platform that does not directly enter into lease agreements with users.
  2. WOSP provides reservation services to Users and Suppliers of Spaces, but does not provide Spaces to Users on its behalf. Space Use Agreements are entered into between the User and the Space Provider.
  3. WOSP strives to ensure that all information posted on its platform is clear, accurate, complete and not misleading. WOSP also tries to ensure that only Spaces that reach certain levels of differentiation, are listed in its platform. However, since it is not the WOSP that makes Spaces available, this level can not be guaranteed.
  4. WOSP relies on Space Suppliers to provide pertinent and accurate information to keep this information current. We do not verify the accuracy or timeliness of the information that is published or provided to us by the Suppliers of Spaces. Space Suppliers acknowledge and accept that they are solely responsible for the content of the information published or provided in respect of any Space advertised on the platform.
  5. Spacing Suppliers need to verify the accuracy of the relevant information on any Space provided to WOSP, including (but not limited to) price, availability and facilities, prior to accepting any Booking Request received via WOSP.
  6. Users acknowledge and accept that WOSP has no responsibility whatsoever in relation to the information published on the platform or that has been provided by the Suppliers of Spaces in relation to the Spaces. Thus, the User acknowledges and accepts that any claim for compensation for loss or damage suffered as a result of or related to the information presented on the Spaces must be presented directly to the Suppliers of Spaces.
  7. The Space Provider agrees that once the Booking Request is accepted, it will accept and be bound to offer its Space on the dates and at the price stated in the Booking Request, and also that the characteristics of the space, the conditions and the facilities of the Space are not materially different from those contained in the WOSP space description page.
  8. WOSP shall not be liable for any breach of any obligation arising out of the Space Use Agreement and / or any defect in the Space provided by the Space Provider.
  9. WOSP shall not be liable for any breach by you of any contract relating to the use of Spaces.

 

Is your data sent to third parties?

No, the data you provide to WOSP will not be shared with third parties, unless explicitly stated, or if you choose to make them public.

How we use your information

  • We can use it to mediate the process of discovery and capture of potential customers for their spaces;
  • We can use it to solve problems and provide support both to you and your customers;
  • For sending promotional and informative content of WOSP, you can stop receiving it at any time by contacting the following email: privacidade@wosp.pt;
  • To make your experience on our website as effective and fluid as possible.

 

Security of your Data

WOSP is committed to managing, maintaining and improving, whenever possible, the security measures required to protect your data, whether located in the European Union or the rest of the world. For this we have manual and automatic ways of doing this, always trying to comply with the GDPR and other rules of data protection.

Your Rights

The control over your personal data is exclusively yours, so we try to ensure the following rights that the law recognizes:

Right of access – You have the right to confirm that we are dealing with your personal data and to access them.

Right of rectification and disposal – You have the right to request the rectification or deletion of your data when you consider that they are no longer necessary for the purposes for which they were collected, and there are more reasons to invoke this right.

Right of opposition – in certain circumstances, and on grounds relating to your particular situation, you may object to the processing of your data. In this case, your personal information will no longer be treated for the purposes to which you have expressed your opposition, unless for compelling legitimate reasons, or in the exercise or defense of possible complaints, we keep them properly blocked during the corresponding periods, as long as the legal obligations remain.

Right of limitation – likewise, the holder of the data may obtain the limitation of the processing of his personal information, without prejudice to the preservation of the same while proving the contestation of the accuracy or legality of the treatment of his data, for the exercise or defense rights, or until it is established that the legitimate grounds for treatment as a result of the opposition prevail over their rights and interests.

Right of opposition for sending advertising – If you do not want your data to be used for commercial purposes, in our case exclusively with WOSP and its users, the ways of exercising this right are provided.

Portability right – In some situations you can ask your data to be exported so that it can be used on another platform.
These rights are provided free of charge and have the right to receive a response within the time limits provided for by the legislation in force.

 

WOSP Rights

By providing access to its web platform, WOSP reserves the following rights and by accessing, browsing or otherwise using the same, you acknowledge and agree that WOSP is entitled to the following:

  1. The right to deny or withdraw access to the web platform in accordance with applicable law for any reason and at any time (with or without notice) if WOSP, in its sole and absolute discretion, considers that it has been violated or you arenot complying with the Terms & Conditions of this Agreement;
  2. The right to suspend, change or deactivate an account, without notice and for any reason;
  3. The right to change or update the web platform, fees, means of payment or the Terms & Conditions of this agreement at any time;
  4. The right to complain to the police or a court if WOSP considers, in its sole and absolute discretion, that conduct (regardless of whether it is demonstrated by using the web platform, services or otherwise) is unlawful.

Intellectual property

  1. WOSP and / or its – are the sole owner of the website, which includes any software, domains and content made available through the web platform. The web platform is protected by the copyright recognized in Portugal and Internationally and by other intellectual property laws;
  2. WOSP and its graphics, logos, icons and service designations related to the web platform are registered or unregistered trademarks or commercial presentations of WOSP. They may not be used without WOSP’s express prior written consent;
  3. The User accepts that WOSP is the copyright holder of any content, regardless of whether it is textual, graphic, photographic or audiovisual, created and published on the web platform.

Security

While we have implemented commercially reasonable technical and organizational measures to prevent the unauthorized use of your personal information and the content of the User, we can not guarantee that unauthorized third parties will not circumvent those measures. You acknowledge that your personal information and the content of the User is provided at your own risk.

  • The User accepts that any information that he publishes on the website, regarding the spaces submitted, constitutes public information and that the other users of the web platform will have access to this information and will be able to comment it. The User may also have private information in their Client Area;
  • You agree that WOSP may republish and use any information you post on the web platform without identifying the source of such information and / or the author of such content. However, we will generally attempt to link your space page when posting content to third-party sites;
  • The User hereby irrevocably waives all moral rights in respect of any content posted by him on the website.

No Warranty & Liability Limits

  1. WOSP renders the Services and makes the web platform “as is” without any warranty or express, implied or legal condition. WOSP shall not be liable for any errors or omissions contained in the Web Platform or the provision of the Services, nor for any failures, delays or interruptions in the Web Platform, nor for any losses or damages arising from the use of the Services or the Web Platform, nor for conduct of users of the Services and the Web Platform. We reserve the right to provide the Services and make the Web Platform available as we see fit.
  2. This clause applies only in the case that the User is a company and not consumer. WOSP, its shareholders, directors, officers or agents shall not be liable (jointly or severally) to the User for:

– loss of profits, business or income;

– loss or manipulation of data, information or software;

– loss of business opportunity;

– loss of anticipated savings;

– loss of goodwill;

– any indirect or consequential loss resulting from or in connection with the provision of the Services and / or the web platform or the Terms & Conditions of this Agreement, regardless of whether you have been advised of the possibility of damages.

Disputes

  1. The User accepts that the Terms & Conditions of this agreement and any litigation, dispute or claim will be regulated and interpreted in accordance with Portuguese law.
  2. Any litigation or claim that arises will be exclusively subject to the jurisdiction of the Portuguese courts.

Cessation

WOSP may change or discontinue the Services and / or Web Platform at any time without notice. We reserve the right to terminate the Terms & Conditions of this Agreement for any reason without notice and the Terms & Conditions of this Agreement will terminate automatically if You do not comply with the Terms & Conditions of this Agreement. In case of termination, the User will immediately cease to use the Services and the Web Platform.

How long do we keep your information?

Your personal data is stored for as long as there is a need for use, according to the purpose of your collection, within the terms of applicable law. We will securely and privately store your data for as long as there is any contractual, commercial or legal relationship between us, WOSP, and you, WOSP user.

These also include consent, if given, to the sending of promotional and informative content, stored until your rights are exercised.
In the moment that your personal data are no longer needed, for contractual, commercial and / or legal purposes, these will be fully eliminated, and at any time you can contact us to eliminate them, in which you will be informed of its the feasibility.

If you do not agree with this Terms, Conditions and Privacy Policy, we ask that you do not use the WOSP platform.
